End User License Agreement

1. Acceptance of Terms

By accessing or using the NinjaChess Telegram mini app game ("the Game") on the TON network, you agree to be bound by these Terms and Conditions and End User License Agreement (EULA). If you do not agree to these terms, please do not use the Game.

2. License Grant

4. Cryptocurrency and In-App Purchases

4.2. All cryptocurrency transactions are final and non-refundable.

4.3. You acknowledge that cryptocurrency values can be volatile and that Gatsby Games is not responsible for any losses incurred due to market fluctuations.

4.4. In-App Purchases (IAPs) may be available using fiat currency or cryptocurrency.

4.5. IAPs are non-transferable and non-refundable, except where required by applicable law.

5. Intellectual Property

5.1. All content in the Game, including but not limited to graphics, code, and text, is the property of Gatsby Games or its licensors.

5.2. You may not copy, modify, distribute, or create derivative works based on the Game's content without explicit permission.

6. User Conduct

6.1. You agree not to use cheats, exploits, automation software, bots, or any unauthorized third-party software to modify or interfere with the Game.

6.2. You will not engage in any activity that disrupts or interferes with the Game's services, servers, or networks.

7. Privacy

Your use of the Game is also governed by our Privacy Policy, which is incorporated into these terms by reference.

8. Disclaimers and Limitations of Liability

8.1. The Game is provided "as is" without any warranties, express or implied.

8.2. Gatsby Games is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Game.

9. Termination

Gatsby Games reserves the right to terminate or suspend your access to the Game at any time, without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties, or for any other reason.
